Customer Terms of Use

These Customer Terms of Use ("Terms") apply when you use Sukify as a customer to hold, claim, or use a digital loyalty card. Sukify is owned and operated by Konseptu IT Consultancy ("Sukify," "we," "us," "our"). If you are a business using Sukify to run a loyalty program, the Merchant Terms of Service apply to you instead.

1. About these terms

By creating a Sukify customer account, claiming a stamp card, or otherwise using the customer app or pages, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use Sukify. Accepting these Terms through the app forms a valid electronic agreement under the Philippine Electronic Commerce Act (Republic Act No. 8792).

2. What Sukify is, and is not

Sukify is a platform that replaces paper stamp cards with digital ones. The loyalty programs, stamps, and rewards belong to the individual businesses you visit, not to Sukify. The business that issues your card is solely responsible for honoring its stamps and rewards, for the terms of its offer, and for the products or services it provides. Sukify provides the technology that records your stamps; we do not sell the rewards and we are not a party to the deal between you and the business.

3. Who can use Sukify

Sukify is intended for customers aged 18 and over. If you are between 13 and 18, you may use Sukify only with the permission and supervision of a parent or guardian who agrees to these Terms on your behalf. Sukify is not intended for children under 13, and we do not knowingly collect their personal data. If you believe a child under 13 has given us personal data, contact us and we will delete it.

4. Your account and access

You can use Sukify with a Sukify account, by signing in with Google, Apple, or Facebook, or through a device-bound card linked to your phone. You are responsible for keeping access to your account and device secure. Cards and account access are personal to you and are not to be sold or shared in a way that defeats a business's reward rules.

5. No cost to you

Sukify is free for customers. We do not charge you to hold or use loyalty cards. Any purchase you make to earn a stamp is a transaction with the business, on the business's own terms and prices.

6. Stamps, rewards, and the business relationship

Each business sets its own rules for how stamps are earned, how many stamps unlock a reward, and when an offer or card expires. Those rules, including the card's own terms and conditions, are set by the business and shown on or with the card. If a business changes its program, closes, or declines to honor a reward, your claim is with that business. We will help where we reasonably can, but we cannot guarantee a business's rewards.

7. Acceptable use

You agree not to:

• Create fake stamps or redemptions, or otherwise cheat a business's loyalty program;
• Use Sukify for any unlawful purpose;
• Interfere with, disrupt, or attempt to gain unauthorized access to the platform or to other users' data; or
• Copy, scrape, or reverse-engineer the app, except to the limited extent the law does not allow this restriction.

8. Your data and privacy

How we collect and use your personal data is explained in our Privacy Policy. In short: Sukify is the controller of your Sukify account and identity, and acts as a processor for the businesses whose cards you hold. You control what optional profile details you share, and you can access, correct, or delete your data as described in the Privacy Policy and on our data deletion page.

9. Service availability

We work to keep Sukify available and accurate but do not guarantee that it will always be uninterrupted or error-free. Features may change over time. We are not liable for downtime caused by events outside our reasonable control.

10. Suspension and termination

You can stop using Sukify and delete your account at any time. We may suspend or close an account that breaks these Terms, that is used to defraud a business, or that creates legal or security risk. If your account is closed, your cards and history may no longer be available to you, subject to our Privacy Policy.

11. Disclaimers and limitation of liability

Sukify is provided on an "as is" and "as available" basis. To the fullest extent allowed by law, we are not liable for the conduct of any business, for rewards a business fails to honor, or for indirect, incidental, or consequential losses arising from your use of the platform. Because Sukify is free for customers, we do not accept liability for ordinary indirect or consequential losses from use of the platform. Nothing in these Terms limits liability for fraud, willful misconduct, gross negligence, data-protection violations, consumer-protection rights, or any other liability that cannot legally be limited.

12. Changes to these terms

We may update these Terms from time to time. For material changes we will give notice in the app or by other reasonable means before they take effect. Continuing to use Sukify after that means you accept the updated Terms.

13. Governing law

These Terms are governed by the laws of the Republic of the Philippines. Any dispute that cannot be resolved informally will be handled by the courts of Cebu City, Philippines, without limiting any right you have to bring a complaint before the appropriate consumer-protection or data-protection authority.
